DearlyStoryTerms of Use

These terms are an agreement between you and the developer of DearlyStory ("we", "us") about your use of the DearlyStory app and service. By creating an account you agree to them. Your use of the app is also subject to Apple's Licensed Application End User License Agreement.
1. Who can use DearlyStory
You must be at least 18 years old to create an account. You may make stories for children to listen to, under your supervision.
2. Voices you create
DearlyStory creates a synthetic voice from a recording that you record in the app or import from a file.
You may only record or import a voice that you have the right to use. That means your own voice, or the voice of a person who has given you permission, or a recording you are otherwise legally allowed to use in this way. You confirm this each time you create a voice.
You are responsible for the voices you create and for how you use them and the audio made with them. We do not check whose voice a recording contains, and we cannot control what you do with it.
You must not use DearlyStory, or any voice or audio made with it, to:
- impersonate any person, or make it seem that a person said something they did not say;
- deceive, defraud or pressure anyone, including asking for money, passwords, verification codes or personal information;
- harass, threaten, defame or bully anyone;
- create sexual content, or content that exploits or endangers children;
- violate anyone's rights, including privacy, publicity and intellectual property rights;
- break any law.
3. AI-generated audio
Stories may be written by AI, and all audio is generated by AI. AI can make mistakes: stories may contain errors, and pronunciation may be imperfect.
Every exported audio file starts with a short spoken notice that the voice is AI-generated, and carries a marker and a trace code in its file details. Do not remove or hide these to mislead anyone about how the audio was made.
4. Your content
You keep your rights to the recordings, text and topics you provide. You give us permission to store and process them, and to have them processed by our providers, only to provide the service to you (for example, to create your voice and read your text aloud). You can use the stories and audio made for you for personal and other lawful purposes, subject to section 2.
Books and texts you import must be ones you have the right to have read aloud for your own use.
5. Stories, purchases and subscriptions
- A story is up to 8 minutes of generated audio at normal speed: one written story, or one part of a book or text. Listening again to audio already made is free. Changing the playback speed does not use extra stories.
- New accounts receive 3 free stories, once per Apple Account.
- Story packs are one-time purchases. Pack stories do not expire.
- Subscriptions renew automatically each month until cancelled. Each billing period includes a set number of stories; unused stories from a period do not carry over. You can cancel at any time in your iPhone Settings, at least 24 hours before the renewal date. Payment is charged to your Apple Account.
- A subscription's stories are used before pack stories.
- If generating a story fails and does not finish within 72 hours, the story is returned to your balance. If you cancel a story after part of it is ready, it counts as used.
- Purchases are handled by Apple. Refunds are handled by Apple under its policies. Stories from a refunded purchase are removed from your balance.
- If you delete your account, unused stories are lost and not refunded. Deleting your account does not cancel an App Store subscription.
6. Reports and removal
Anyone can report misuse in the app (Me → Report a problem or misuse) or by email. When we receive a report about a voice, we may pause it within 24 hours: it cannot be used to make new audio, and its audio cannot be exported. We will let the account holder know and give them 7 days to respond. After reviewing, we will restore or remove the voice and its audio. We may suspend or close accounts that break these terms.
7. Availability and changes
We work to keep DearlyStory running, but we do not guarantee it will always be available or error-free. We may change or discontinue features, and we may update these terms. If a change is significant, we will tell you in the app, and continuing to use DearlyStory after that means you accept the updated terms.
8. Disclaimers and liability
DearlyStory is provided "as is". To the extent permitted by law, we disclaim all warranties, and we are not liable for indirect or consequential damages, or for how you or others use voices and audio made with the service. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
9. Ending your account
You can delete your account at any time in the app (Me → Account settings → Delete account). We may end your access if you seriously or repeatedly break these terms.
